PEUGEOT DRIVE EUROPE BOOKING CONDITIONS – 2019 & 2020 COLLECTIONS
1. Clarification
Please read the following booking conditions carefully. You must not submit a booking request unless you understand and agree with the following booking conditions. References to “us”, "we" or "our" in these booking conditions shall mean Drive Holidays Limited trading as Peugeot Drive Europe.
These booking conditions apply to bookings you make with Peugeot Drive Europe directly, or through any of our agents.
Peugeot Drive Europe is a division of Drive Holidays Limited, an Armstrong Motor Group Company. Peugeot Open Europe is the official name of the Peugeot brand new car leasing/purchase scheme of vehicles registered in France under the temporary transit system in Europe belonging to and operated by “Automobiles Peugeot Sodexa” (hereinafter referred to as “Sodexa”), a division of Automobiles Peugeot. Peugeot Drive Europe is authorised to market for Sodexa its Peugeot Open Europe new car leasing/purchase scheme and to obtain orders on its behalf. Accordingly we act for Sodexa in the capacity as booking agent. We do not provide the underlying vehicle, accessories or associated services. When you formalise the contractual arrangements you will be contracting directly with Sodexa. The contract between Sodexa and you will be set out in the Peugeot Open Europe Purchase Order, including the Sodexa general sale and guarantee terms attached to that form, and any subsequent agreement between you and Sodexa. For completeness, such contract will be subject exclusively to French law.
These booking conditions and the Sodexa general sale and guarantee terms are subject to change without notice. You agree you will be bound by any subsequent booking conditions and Sodexa general sale and guarantee terms. For completeness Sodexa is responsible for the provision of the vehicle, accessories or associated services.
2. Booking Requests
To make a booking request you shall be required to provide Peugeot Drive Europe with information specified by Peugeot Drive Europe from time to time. Prior to your departure you will be required to complete and sign a Peugeot Open Europe Purchase Order based on the Sodexa general sales and guarantee terms, which we will submit to Peugeot Open Europe for acceptance. Until the Peugeot Open Europe Purchase Order is received and accepted, by Peugeot Open Europe and French Customs, your booking is not guaranteed.
Peugeot Drive Europe reserves the right to decline any booking request and/or Peugeot Open Europe Purchase Order if, in its sole discretion, Peugeot Drive Europe forms the view that the information or application is incomplete, the applicant does not meet the applicable eligibility criteria set out in these booking conditions, the chosen vehicle is unavailable on the dates and/or locations desired, Sodexa no longer offers the chosen vehicle under the Peugeot Open Europe scheme, or there is a disagreement concerning the value of any payment to be paid by you.
3. Eligibility
In order to be eligible for tax-free status and thereby for a Peugeot Open Europe contract, for a maximum of 175 days with Temporary Transit (TT) plates, you must comply with the following conditions:
- – You are a natural person (i.e. individual);
- – You have your principal residence outside the customs territory of the European Union (EU) or in a French Overseas Departement or in New Zealand;
- – You will spend fewer than 185 days over a period of 12 consecutive months in the EU;
- – You will not undertake any profit-making or form of remunerated activity (including employment) during your stay.
We may require evidence that you meet these requirements (e.g. European citizens residing outside the EU are to provide a copy of their New Zealand residency visa and/or a letter from their employer (or themselves if retired, without profession or self-employed) of their intention to return to their employment (outside the EU) at the end of their stay in the EU). If you are on temporary assignment in the EU, such as a professor, journalist or full-time student, you may also be required to provide evidence of compliance with the eligibility criteria. When assisting with any booking, we will assume that you comply with the above Eligibility criteria. If this is not the case, you must let us know.
4. Guaranteed Buy Back
The Peugeot Open Europe scheme is based on a tax-free sale with guaranteed buy back. Forming part of the Peugeot Open Europe Purchase Order, is the requirement to provide current credit card details. These will act as a guarantee to Sodexa that you will return your vehicle as agreed and cover any charges for the non-return of any items (i.e. registration document, keys etc), any changes to your return location (if outside of France) and any other legitimate charges (i.e. parking fines, abandonment fee if vehicle not returned to a Peugeot location etc).
5. Inclusions
In accordance with the Peugeot Open Europe Purchase Order, you will be provided with: a brand new Peugeot vehicle, unlimited kilometres, comprehensive insurance* for vehicle damage, theft and third party liability (including cover for glass, “wrong fuel” and punctures) with no excess, access to the Peugeot Open Europe 24/7 Assistance call centre, anti-theft device on all models, emergency triangle & reflectorised jacket, full factory warranty, location information and no additional driver fees (conditions apply).
*Your personal belongings are not covered by the insurance. A summary of the terms and conditions of the comprehensive insurance guarantees is submitted to you by Peugeot Open Europe at the time of delivery of the vehicle. For more information contact Peugeot Drive Europe. The comprehensive insurance does not apply to any rental vehicle that may be offered to you as replacement for the vehicle for any reason and the automobile insurance subscribed to by the rental agency will be applicable on the basis of conditions described in the rental contract.
6. Minimum/Maximum Lease Period
With the exception of a short-term lease (up to 17 days, or 18-20 days), the minimum paid lease period is generally 21 days, although you can return your vehicle within 21 days without any reimbursement. The maximum lease period is 175 days*.
*Maximum lease period is 90 days if collection and return is in Portugal, plus Portuguese customs state that you cannot spend more than 90 days in a tax-free car in Portugal.
Note: days are calculated on calendar days, not 24 hour periods.
7. Booking & Purchase Order Deadlines
All booking requests are subject to availability. Bookings should be made as far in advance as possible to have the best chance of obtaining the vehicle of your choice. Following receipt by Peugeot Drive Europe of sufficient information to facilitate a valid booking request, and the required deposit set out below, we will submit appropriate details to Sodexa to book your vehicle. Following confirmation of your booking from Sodexa we will send you an invoice for the total price payable for your vehicle in New Zealand dollars. The total price payable specified on the invoice is subject to Paragraphs 18 “Prices” and 28 “Modifications/Variations” below. Full payment and the completed and signed Peugeot Open Europe Purchase Order, referred to in Paragraph 2 “Booking Requests” above, must be received by our office at least 6 weeks prior to your departure from New Zealand to ensure your vehicle can be registered, insured and delivered on time. Your booking request will not be guaranteed until your Peugeot Open Europe Purchase Order and full payment are received by us.
Urgent booking requests, within 28 days of collection, must be accompanied with a $1,500 deposit. If an urgent booking request is made and confirmed by Sodexa, the balance of payment and Peugeot Open Europe Purchase Order must be received by Peugeot Drive Europe on the day of confirmation.
8. Power of Attorney
Subject to the agreement between you and Sodexa, if the holder of the Peugeot Open Europe Purchase Order (the “Contract Holder”) cannot collect the leased vehicle his/her spouse or cohabiting partner (“Partner”) may do so on his/her behalf by producing an original Power of Attorney duly drawn up and signed in the that person’s favour by the Contract Holder. The Partner must also qualify in the same “category” as the Contract Holder under the scheme (refer “Eligibility”). Please contact Peugeot Drive Europe for this Power of Attorney template document.
9. Vehicle Selection
Please choose your vehicle carefully as you are unable to change your vehicle on collection.
Note: all vehicles are left-hand drive.
10. Who Can Drive
The driver must be over the age of 18 years (no maximum driver age) and hold a valid full driving licence recognised in the countries entered during your stay. If you hold a full New Zealand drivers licence, an International Drivers Permit (in conjunction with your New Zealand licence) is a requirement in most European countries, both within and outside the EU. You are responsible for ensuring you meet the driving requirements of the countries entered during your stay. Contact Peugeot Drive Europe for more information.
The leased vehicle may be driven only by the Contract Holder or his/ her Partner (i.e. spouse or legal cohabiting partner), direct descendants or ascendants, if they qualify for the scheme (refer “Eligibility”) and hold valid full driving licences (as noted previously). Direct ascendants/descendants may only drive the vehicle locally and cannot drive across country borders without the Contract Holder. The spouse/legal co-habitant can cross country borders, even if the Contract Holder is not in the vehicle, but if their surname does not match the Contract Holder an official document must be carried to prove the relationship (e.g. marriage certificate or similar). Other drivers (not descendants/ascendants/spouse/legal cohabiting partner) can only drive the vehicle if they meet the same Eligibility conditions as the Contract Holder and the Contract Holder is inside the vehicle and unable to drive due to an emergency or exceptional circumstances.
The leased vehicle may not be used in any way to generate any income, profit or gain.
The above criteria is subject to the Sodexa general sale and guarantee terms applicable to your agreement with Sodexa and local law governing driver regulation. When assisting with any booking request, we will assume that all drivers comply with the above criteria.
11. Collections/Returns
Collections and/or returns at Peugeot Open Europe locations in France are free of charge. Collections and/or returns outside of France are at an additional charge and must be pre-paid. Pre-paid fees are non-refundable if you change your plans and return your vehicle inside France. Conversely, if your plans change and you return your vehicle outside of France, a fee will apply and must be arranged with, and paid directly to, Peugeot Open Europe in Paris. All collection, return and associated fees are subject to change by Peugeot Open Europe.
12. Vehicle Collection
Please phone or email the collection location 4 working days in advance, if you have not provided flight details, to confirm your collection time. If you are running late, you must call the collection location as they will only wait for you for up to 1 hour after the actual arrival time of your scheduled flight and 30 minutes after the time of the appointment.
On collection you must show your passport, driver’s licence/s and copy of the Peugeot Open Europe Purchase Order. Registration and insurance documents are provided on collection. All vehicles are delivered with 10-15 litres of fuel – meaning you need not top-up the fuel tank on return.
13. Servicing
Most Peugeot vehicles require their first service at either 15,000kms or 20,000kms – at your expense. Refer servicing card delivered with the vehicle for more information. Scheduled servicing must be done at Peugeot service stations.
14. Accessories / Tyres
Child seats (compulsory for children under 10 years in France), and other accessories are at an additional charge (to be pre-paid) and must be requested at the time of booking. Accessories will not be reimbursed when the vehicle is returned. All vehicles are fitted with standard tyres only. To meet the legal requirements of some countries over the winter months (Nov-Mar, or as the weather requires) you may need a vehicle with special tyres and/or snow chains. 15. Vehicle Insurance/Assistance
Subject to the Sodexa general sale and guarantee terms, you have the comprehensive Insurance referred to previously and below and access to the Peugeot Open Europe 24/7 Assistance call centre if you drive in any of the following countries: Austria, Belgium, Bosnia-Herzegovina, Bulgaria, Croatia, Cyprus (Greek part), Czech Republic, Denmark, Estonia, Finland, France (Mainland, including Corsica), Germany, Gibraltar, Greece (excludes Islands), Hungary, Iceland, Ireland, Italy (including Sardinia and Sicily), Latvia, Lithuania, Luxembourg, Macedonia (FYROM), Malta, Montenegro, Netherlands, Norway, Poland, Portugal (including Madeira and Azores), Principalities (Andorra, Liechtenstein, Monaco), Romania, San Marino, Serbia (excludes Kosovo), Slovakia, Slovenia, Spain (including Balearic and Canary Islands), Sweden, Switzerland, United Kingdom (England, Scotland, Wales and Northern Ireland), Vatican City.
You are not permitted to drive into any countries not listed above.
Your vehicle Insurance policy and Assistance package are subject to exclusions, limits and procedures. It is your responsibility to make yourself aware of these. Refer our website http://www.peugeotdriveeurope.co.nz/peugeot-drive-europe-information/insurance/. Should your vehicle be involved in an accident or breakdown, you will be provided with a rental car* or accommodation subject to the Peugeot Assistance terms and limits. Once the vehicle is repaired you must return your rental car to the place of collection and collect your vehicle from the Peugeot garage. Comprehensive travel insurance is vital to cover some/all costs that Peugeot does not cover.
*Subject to minimum/maximum driver age restrictions with rental car companies.
16. Additional Costs
Additional costs, such as petrol/diesel, oil, motorway/toll charges and traffic/parking violation fines are not included and are your responsibility.
If you do not return the registration certificate, both keys, warranty/service booklet, emergency triangle and reflectorised jacket with the vehicle you will be charged for these items on your credit card.
17. Travel Insurance
Travel insurance is strongly recommended by Drive Holidays Limited and the Ministry of Foreign Affairs and Trade for all overseas travel. Please ensure you have arranged this before placing your reservation.
18. Prices
All prices invoiced by Drive Holidays Limited are in New Zealand dollars and guaranteed for 7 days from the date of invoice, after which time they may be subject to change without notice (e.g. for currency fluctuations).
We can only accept booking requests from persons residing in New Zealand who meet the eligibility criteria set out in Paragraph 3 “Eligibility”.
We currently accept credit card payments by way of Visa or MasterCard only. Payment by way of Visa or MasterCard will attract a surcharge of 1.5%.
19. Booking Deposit
For booking requests made more than 28 days before collection, a non-refundable deposit (subject to your rights under the Consumer Guarantees Act 1993) of $300 is required at the time of placing your booking request.
For booking requests made within 28 days of collection, a non-refundable deposit (subject to your rights under the Consumer Guarantees Act 1993) of $1,500 is required at the time of placing your booking request.
20. Amendments
Amendments, regardless of the change, are subject to acceptance by Peugeot Open Europe. Amendments after the Peugeot Open Europe Purchase Order has been received will incur a minimum $200 fee. Name changes are only possible prior to the vehicle being registered and will incur a fee of $200, or $400 if final documents have been issued. You agree to pay such amendment fees on demand by Drive Holidays Limited. We will not submit an amendment request until payment of the applicable amendment fee has been received by us.
No amendments can be made within 21 days of collection.
21. Cancellations
As noted previously travel insurance is highly recommended. You are responsible for the following cancellation fees (if applicable), which are strictly enforced.
Cancellations more than 28 days prior to collection = $300 fee, or $400 if documents have been issued. Cancellations less than 28 days prior to collection = $600-$1,800 (depending on whether the vehicle has been registered). Cancellations on the day of collection or “no shows” = $1,800. Any travel agent fees are in addition to these charges.
22. Extension of Your Contract
If, whilst in Europe, you decide to extend your lease period you must contact Peugeot Open Europe in France directly. Refer your documents (or our website) for procedure and cost. You are liable for all civil, material and criminal costs/actions if your vehicle is not returned as expected and you have not paid for an extension.
23. Early Returns
As at the date of these booking conditions a refund will only be considered by Sodexa if the original lease period was 30 days or more and the return date is at least 7 days prior to the pre-booked return date. Refunds of less than 7 paid days cannot be considered. Refunds are calculated by deducting the cost of the duration utilised from the cost of the duration booked, less a 20% Sodexa fee, less a $50 Peugeot Drive Europe fee. The first 21 days and any ‘free’ days are strictly non-refundable.
24. Customer Claims
Any requests for reimbursement must be pre-approved by Peugeot Open Europe Assistance and/or Sodexa. We will assist you in lodging a claim if necessary. Such claims must be lodged with Peugeot Drive Europe within 14 days of your vehicle return date and supported by original invoices and receipts with the Contract Holder’s name and vehicle registration number detailed by the provider (duplicates or photocopies will not be accepted). Peugeot Drive Europe is not liable for any claim made by you, including for any claim that is declined by Sodexa.
25. Accuracy of Information
All prices and information contained on our website, current brochure or price-list were correct at the time of publishing and are subject to change in accordance with paragraph 28 (e.g. for changes imposed by Sodexa/Peugeot Open Europe, currency fluctuations from time to time or for any other reason).
26. Privacy
You agree that any personal information provided by you, or any travel agent on your behalf, to Drive Holidays Limited or the Armstrong Motor Group may be kept and used by Drive Holidays Limited or the Armstrong Motor Group for the purposes of communicating with you or Peugeot Open Europe, undertaking research and/or promoting and marketing other products and services of Drive Holidays Limited or any entity within the Armstrong Motor Group. You have the right under the Privacy Act 1993 to obtain access to and to request correction of any personal information held by Drive Holidays Limited or the Armstrong Motor Group concerning you.
27. Disclaimer
All reservation invoices/confirmations, vouchers, receipts and other documentation are issued subject to any and all terms and conditions under which items or services are provided by Peugeot Open Europe or Sodexa. Drive Holidays Limited and its servants and agents shall not be liable for any injury, damage, loss, accident, delay or irregularity, additional expense or liability occasioned to any person or property howsoever caused or arising including, but without limiting the generality of the foregoing, whether due to the act, neglect, default or otherwise from acts of God, dangers incident to the air, land or sea, fire, breakdown in machinery or equipment, force majeure or acts of de facto Governments or authorities, wars whether declared or otherwise, riots, strikes, insurrections, theft, pilferage, epidemics, quarantine, medical, custom or other regulations, dissatisfaction with any service provided, any inaccuracy or misdescription contained in any website, current brochure or price-list to which these booking conditions relate, delays and cancellations of or changes in itinerary or schedules or over booking, improper or insufficient passport, visa or other travel documents or by any act, neglect, default or otherwise of Peugeot Drive Europe, Drive Holidays Limited, Peugeot Open Europe or Sodexa, their servants or agents or any other person or any other cause which is not within the control of Drive Holidays Limited or Peugeot Drive Europe.
Drive Holidays Limited, as agent for Sodexa, is entitled to a commission, which we will deduct from the final payment remitted to Sodexa in accordance with the terms of our agency agreement with Sodexa.
28. Modifications/Variations
If, due to unforeseen circumstances, your requested Peugeot is unable to be delivered, Peugeot Open Europe / Sodexa reserves the right to provide you with an alternative Peugeot vehicle, or, if necessary, a rental car. If a rental car is provided, you will be bound by the conditions of the rental car company.
Peugeot Drive Europe, Drive Holidays Limited, Peugeot Open Europe and Sodexa also reserve the right to modify the models, equipment and prices offered in their websites, current brochure or price-list without prior notice.
